QuestAway Terms of Use
1. Who we are
QuestAway (the Game) is developed and operated by ART X GAMES TECNOLOGIA LTDA (ART X, we, us), a Brazilian limited liability company registered under CNPJ 68.279.774/0001-37, with its head office at Rua Amazonas, 83, Letra C, Boa Vista 2, Santa Rita do Sapucaí, Minas Gerais, Brazil, ZIP 37538-640.
Contact (player support, legal matters, reports, appeals against penalties and privacy): contact@artxgames.com
2. What these Terms cover
These Terms of Use (the Terms) are the agreement between you and ART X about the use of the Game, the Game's online services (server, ranking, Arena, Colossus, Social and clans, houses, Mail, players' market and Crystal shop) and the pages of this site (together, the Services).
The Game is distributed by Valve Corporation through the Steam platform. Your Steam account, purchases made on Steam, Steam refunds, trades between users and the Steam Community Market are governed by the Steam Subscriber Agreement and Valve's rules, which ART X does not control. These Terms complement those rules and do not replace them. Valve is not a party to these Terms and is not responsible for the Game.
How we handle your personal data is described in the QuestAway Privacy Policy, which is part of these Terms.
3. Acceptance and age
To use the Game, you must read and accept these Terms. The Game asks for your acceptance the first time it connects to our servers and whenever we publish a relevant change (section 18). Your acceptance is recorded in your account, with the accepted version and the date. Without your acceptance, the Game only works in offline mode, without the online services.
You must be old enough to have a Steam account in your country, and never younger than 14. If you are under 18 (or have not reached the age of majority in your country), you may only use the Game with the permission and supervision of your parent or legal guardian. The guardian who allows the use accepts these Terms on the minor's behalf, oversees the use of the Game and is responsible for purchases made on the account, within the limits of the law.
The Game is not directed at children under 14.
Features involving value. If you are under 18 (or have not reached the age of majority in your country), you may only buy and sell on the Game's market (section 9.1) with the consent of your parent or legal guardian. If Steam or another store starts to provide the age range of the account (such as the age signal that Brazilian law requires app stores to provide), we may use it to limit or block these features on minors' accounts.
Age rating in Brazil: Not recommended for under 14 (Violence, Online purchases, User interaction).
Parents and guardians. Steam's own tool, Steam Families, lets you limit purchases, playtime and access to community features. In the Game, the Social tab has blocking and reporting, and lets you limit who can send friend requests, who can see the items of your heroes and whether friends see "playing now" (the default for each is in the Privacy Policy, section 4). The Game has no chat of its own between players (chat between friends is Steam's own) and shows no advertising. To talk about a minor's account or to ask for it to be deleted, write to contact@artxgames.com.
Purchase made by a minor. If a Crystal purchase was made by a minor without the guardian's permission, the guardian may ask for it to be cancelled and the amount refunded within 30 days of the purchase, as long as the Crystals have not been used.
4. The Game and the online services
QuestAway is an "idle" game: your heroes progress on their own while the Game is open. It can be played:
- online, with progress saved and checked on our server, and with access to the ranking, the Arena (fights between players), the Colossus, Social and clans, visitable houses, Mail, announcements, the players' market and the Crystal shop;
- offline, with progress saved only on your computer. Some features, such as the Crystal shop, need an internet connection even in offline mode (except after the online services are closed, section 13).
The Game is an evolving service. We may release updates, fix bugs, add or remove content and features, and adjust the Game's balance (for example, item attributes, drop chances, gold prices and the strength of heroes, enemies and skills) to keep the Game fair and fun. Changes that players notice are published in the patch notes. Balance adjustments may change how useful items you already own are; this is part of the nature of the Game and does not entitle you to compensation, except where the law provides otherwise. We will not permanently remove content you have paid for without offering you an equivalent solution or whatever the law requires.
Some updates are required to keep using the online services: an old version of the Game may stop connecting to the server until it is updated.
5. License
The Game is free to play. When you obtain it on Steam, ART X grants you a personal, limited, non-exclusive and non-transferable license to install and play the Game for your entertainment, under these Terms and Steam's rules. The license may only be suspended or terminated in the cases set out in these Terms (section 10). The Game is licensed, not sold: the code, art, sounds, texts, trademarks and all content of the Game remain the property of ART X or its licensors.
Except where the law expressly allows it, you may not:
- copy, modify, translate, decompile, disassemble or reverse engineer the Game, its save file or its communication with the server;
- distribute, rent, sublicense or commercially exploit the Game or parts of it;
- create or use unauthorized servers, tools or versions of the Game;
- remove copyright or trademark notices.
Videos and streams are welcome. You may record, stream and publish videos and images of the Game, including with monetization on video platforms, as long as you do not suggest that your content is official or sponsored by ART X and you follow the platform's rules.
6. Your account
The Game uses your Steam account to identify you. We do not create our own login or password. You are responsible for keeping your Steam account secure (we recommend Steam Guard) and for everything done with it. If you notice misuse of your account, tell Steam and our support.
Your Game account is personal. Selling, buying, lending or sharing Game accounts, or using several accounts to gain an advantage (for example, to gather items and sell them in the Game's market), is prohibited. Each account has one online session at a time: logging in from another place ends the previous session.
Closing your account. You may close your account whenever you want, by asking for its deletion at the email address in section 1 (Privacy Policy, section 9). Deletion erases your online progress and your unused Crystals and cannot be undone; before asking, use whatever you want to make the most of. It does not prevent the refund you are entitled to under the right of withdrawal (section 8).
7. Rules of conduct
When using the Services, you agree not to:
- use cheats, hacks, injectors, memory or save editors, or any program that changes how the Game works or how it communicates with the server;
- use bots, macros, scripts or other automation outside the Game. The Game's own automatic progress is allowed: that is how it works;
- exploit bugs or flaws in the Game to gain an advantage instead of reporting them;
- run several accounts, someone else's accounts or several copies of the Game at the same time to accumulate items, Crystals or advantages;
- sell, buy, rent or share accounts, or advertise inside the Game (in clan names, in the profile or the house) buying or selling accounts, Crystals or items for money (sales of Crystals and items outside the Game follow section 9.3);
- use Crystals or Game items on betting, paid raffle or gambling sites, or in affiliate programs linked to them;
- overload, attack, probe the security of or try to access our servers without authorization, or collect data from them by automated means;
- impersonate the ART X team or anyone else;
- use the Game for illegal purposes or to violate the rights of others;
- try to get around a penalty, including by creating another account;
- open the Game with debugging, remote-control or automation tools attached to it;
- manipulate the Game's market or the rankings: fix prices or bids, trade with yourself or between coordinated accounts to move items, Crystals or gold, artificially inflate or crash prices, post and cancel listings in series, or fix results in the Arena, the Colossus or the clan Hunt;
- transfer items, Crystals or gold to get around a lock, a limit or a penalty;
- help another person do what this section prohibits (for example, operating a bot or an account for them, or receiving items from a punished account knowing it).
The server checks all progress sent in online mode. Progress that does not follow the Game's rules is rejected automatically, and the Game returns to the last valid state. If you think this was a mistake, contact support: a team member will review the case.
8. Crystals (virtual currency)
Crystals are the Game's virtual currency. They are bought on Steam, in packs, and used in the Game to unlock content such as hero classes, companions (pets), stash tabs, conversions, skins, balloons and house furniture.
- Steam processes the payment. ART X does not receive or store your card or payment details. The price, taxes and currency are those shown by Steam at the time of purchase.
- Delivery. Crystals reach the Game after Steam confirms the purchase. If they do not arrive, contact support.
- Nothing random is for sale. ART X does not sell anything drawn by chance: no content sold for money or for Crystals in QuestAway is random, and you always know exactly what you are buying before you buy it. In the players' market, nothing with a random result can be bought with Crystals: items of that kind are traded only for gold.
- Validity. Crystals do not expire; if the online services are closed, they remain available in offline mode (section 13). If the law of any country requires Crystals bought there to have a validity period, it will only apply to purchases made after a notice given in advance inside the Game, and never to Crystals already bought.
- Use. Spent Crystals unlock the chosen content and do not come back as Crystals, except in the exchanges the Game itself offers (such as reselling house furniture and sales in the Game's market, under the conditions shown on screen).
- Transfers. You can send Crystals to another player through the Game, under the conditions on screen. A transfer is final: it is only reversed in case of a Game error or fraud.
- Right of withdrawal. You may withdraw from the purchase of a Crystal pack within 7 days of the purchase (Brazilian Consumer Protection Code, art. 49), if no Crystal from the pack has been spent, by writing to contact@artxgames.com with your SteamID and the date of purchase. We confirm receipt, remove the Crystals and ask Steam to refund the amount paid, to the same payment method. If you live in a country with a longer period or more favorable conditions, those apply.
- Refunds through Steam. You may also ask Steam for a refund, when its policy allows it for in-game purchases. If a purchase is refunded, the corresponding Crystals and the content unlocked with them may be removed from your account.
- Chargebacks and fraud. If a purchase is disputed with your bank or card issuer (chargeback), or is made with a fraudulent payment method, we first remove from the account that made the purchase the corresponding Crystals and, if needed, the content unlocked with them. Its balance may go negative until it returns to zero, and until then it cannot spend. We only remove Crystals or items from someone who received them afterwards if that person took part in the fraud, knew about it or received them outside what the Game allows. Whoever received them in good faith and has already used the Crystals keeps what they bought. In case of fraud, we also apply the measures in section 10.
9. Trades and sales between players
Content bought with Crystals cannot be transferred outside the Game: it stays tied to the Steam account. Classes, companions (pets), heroes, tabs and furniture obtained with Crystals cannot be sold, traded or transferred outside the Game. Inside it, only through the Game's market, when it offers that option for that content, under the conditions shown on screen (section 9.1). Crystals can pass to another player through the Game (section 8).
9.1 The market inside the Game
If the Game offers a market or trading between players inside it, these rules apply, together with those shown on screen:
- you may buy from ART X or from other players and sell to other players, under the conditions on screen; trades between players use Crystals or another in-game currency indicated on screen, never money, and only inside the Game;
- Crystals you receive from a sale follow section 8: ART X does not buy them back or exchange them for money;
- the Game charges a fee in Crystals on each sale, shown before you confirm;
- when the Game allows selling heroes, a hero you sell goes to the buyer with its level and equipment, and the Game asks for your confirmation first;
- the Game may charge fees in that currency, limit the quantity, value and frequency of trades, require account conditions (such as playtime) and lock items for a period;
- the Game does not let an account use the market while Steam reports a community or trade ban on its Steam account (section 10);
- if you are under 18, you may only buy and sell on the Game's market with the consent of your legal guardian (section 3);
- a completed trade cannot be undone, except in case of a Game error, fraud or breach of these Terms. In those cases we may reverse it and apply the measures in section 10, but we only remove items or currency from someone who took part in the fraud or the breach, knew about it or received them outside what the Game allows (section 8);
- ART X provides the tool and is responsible for how it works under the law, but does not set prices or guarantee value;
- trades are recorded, as described in the Privacy Policy.
9.2 What applies to all trades
The Game may limit how many tradable pieces each account earns per day; those above the limit are bound to the account and can only be used to play.
Items obtained through cheating, bug exploitation, fraud or breach of these Terms may be removed from the Game, and trading may be blocked on the account involved. Selling or buying accounts, and using Crystals or items on betting sites, is prohibited (section 7). You are responsible for any taxes the law of your country charges on what you sell.
9.3 Sales outside the Game
ART X only sells Crystals through Steam, does not buy them back and has no partner sites for buying or selling Crystals or items. If you sell or buy Crystals or Game items for money with another person outside the Game (for example, on third-party sites), the deal is only between you and whoever intermediates it:
- ART X takes no part in it, does not guarantee payment, delivery, price or anyone's identity, is not liable for scams and does not settle disputes;
- no site is official or a partner of ART X, even if it says so;
- Crystals and items of fraudulent origin (chargebacks, stolen cards or accounts) received in such deals outside the Game may be removed from whoever holds them (section 8);
- never give your Steam password or access to your account to anyone: selling accounts remains prohibited (section 7).
10. Penalties and appeals
If you break these Terms, we may, depending on the seriousness and repetition of the conduct:
- warn you;
- remove items, Crystals or progress obtained irregularly;
- lock the account's Crystal balance, items or trades between players, and cancel its listings on the Game's market;
- suspend access to the online services for a period of time;
- permanently ban the account from the online services, in serious or repeated cases.
Whenever possible and safe, we will tell you the reason for the measure. Measures against fraud or attacks may be applied immediately to protect the Game and other players.
Protecting the Game's economy. To prevent fraud, chargebacks, money laundering, multiple accounts and automation, the server flags, as described in the Privacy Policy:
- unusual activity (for example, many Crystals or many trades in a short period, or accounts that always trade with each other);
- accounts that use the same computer or the same network;
- a pace of actions too regular for a person;
- signs that a program is operating the Game.
The server also checks with Steam, every day, for purchases that were charged back or disputed and for accounts locked by Steam and, each time you log in to the online services, whether the Steam account has bans.
The flag alone punishes no one: a team member reviews the case before applying a measure under this section, and every measure is recorded.
The one exception is the market: an account whose Steam account has a community or trade ban, as reported by Steam, cannot use the players' market or send items to Steam while the ban lasts.
Appeals. You may contest any measure within 30 days by writing to contact@artxgames.com with your Steam name and SteamID. A team member will review the case and reply within 15 days. If the measure was a mistake, it will be reversed and anything removed will be returned.
The removal of what was obtained irregularly, and the suspension and ban applied for breaching these Terms, such as multiple accounts, automation, exploiting bugs or manipulating the market, do not entitle you to a refund or compensation for Crystals, items, content or progress, except where the law provides otherwise and where the measure is reversed on appeal. A ban from the online services does not remove the Game from your Steam library.
11. Social features
The Game has features in which other players see information about you: the ranking, announcements of rare items and achievements, visitable houses (with the decoration, the house picture and your hero party), stamps, likes, the Arena, Social and clans, and the Colossus. What appears in each one, and how to hide your name, is described in the Privacy Policy. The Game has no chat of its own between players: the Chat button opens Steam's own chat, between Steam friends.
Social, clans and the Colossus. Your friends in the Game see your name, level, where you are and whether you are playing. Any player can see a clan's page (name, tag, crest and members). In the Colossus, whoever is in the room sees your balloon and your group of heroes, and the list of top hunters shows your name, unless you hide it. What each person sees and how to limit it is in the Privacy Policy (section 4) and in the Social tab.
The Arena. In the Arena, players fight each other with their hero parties. The formation you choose for the Arena defends your account even when you are not playing: other players can attack it, and the result changes the points and the league of both sides. Afterwards you can see, in the history, the fights in which your defense was attacked. The live challenge, made by invitation, is friendly and does not change points.
Prizes. Game competitions and hunts, such as the Arena seasons and the Colossus, may give prizes in gold, items, chests or Crystals, under the rules shown in the Game (for example, a minimum number of fights in the season). The medal and the prize of a competition or hunt depend only on performance in the Game, and you do not pay to take part. The contents of a chest won in the Game may be drawn by chance, but no chest, key or raffle can be bought. Prize Crystals follow section 8. We may remove a prize obtained through cheating, bug exploitation or another breach of these Terms.
By building your house, you allow us to show it to other players and to display images of it in the Services and in the promotion of the Game, free of charge, while it is published.
Suggestions. If you send us ideas, suggestions or bug reports, we may use them to improve the Game with no obligation to pay or credit you.
11.1 Conduct in social features, clans and reports
Clan names, tags, crests, the house, clan wall notes and everything else other players see are subject to these Terms. It is prohibited to use these features, or your profile name, to:
- insult, harass, threaten, intimidate or discriminate against anyone;
- incite hatred or violence;
- show sexual or illegal content;
- expose other people's personal data;
- engage in any contact or interaction that violates the rights of children and teenagers, such as grooming, exploitation, asking for photos or personal data, or inviting them to chat in private outside the Game.
Clan names and tags go through a filter, and we may change or remove them if they violate these Terms. You authorize us, free of charge, to display them in the Game.
How to report. Use the Report button on the profile card, or write to contact@artxgames.com (including to report a clan's name). Keep the protocol number. A team member reviews it, and we tell the reporter the outcome within a reasonable time. Content that is illegal or that violates the rights of children and teenagers is reviewed as a priority and, where appropriate, reported to the authorities.
A false or mass report made to harm someone is an abuse of the feature and may lead to a warning, suspension of the account or a ban (section 10), with the right to appeal.
Controls. In the Social tab you can block any player, limit who can send you friend requests or see the items of your heroes, and turn off "playing now". Chat between friends is Steam's own.
12. Availability and maintenance
We do our best to keep the online services running, but they may be unavailable because of maintenance, updates, technical failures, failures of Steam or the internet, or reasons beyond our control. We will announce scheduled maintenance whenever possible. Offline mode remains available when the server is down, within the limits described in section 4.
We keep backups of online progress, but we recommend not relying on a single copy: the offline save is stored on your computer and is your responsibility. Deleting the save in the Game cannot be undone.
13. Shutting down the online services
We may shut down the Game's online services. If that happens:
- we will give at least 60 days' notice, in the Game and on the Game's Steam page;
- we will stop selling Crystals from the moment of the notice;
- the Game will remain playable in offline mode, and your unused Crystals will go with you to be spent in the offline-mode shop;
- the features that depend on the servers, such as the ranking, the Arena, the Colossus, Social and clans, visitable houses, Mail, announcements and the players' market, will stop working;
- the rights the law grants you are preserved.
14. Intellectual property
QuestAway, ART X, ART X GAMES, the logos, characters, art, sounds and other elements of the Game are protected by copyright and trademark law and belong to ART X or its licensors. Steam and the Steam logo are trademarks of Valve Corporation. Nothing in these Terms gives you rights over these trademarks or content beyond the license in section 5.
15. Warranties and liability
We work to make the Game run well, but no software is free of errors. Beyond the warranties provided by law, we do not guarantee that the Game and the Services will work without interruptions or errors.
16. Privacy
The handling of your personal data follows the QuestAway Privacy Policy and the Brazilian General Data Protection Law (Law 13,709/2018). Read the Policy to learn what data we process, why, for how long and how to exercise your rights.
17. Communications
We may contact you through the Game itself (team messages, Mail and notice screens) and through the Game's Steam page. You can contact us at the email addresses in section 1.
18. Changes to these Terms
We may update these Terms, for example to cover new Game features or changes in the law.
- Relevant changes, which affect your rights or obligations, will be announced at least 15 days in advance in the Game, unless the change is required by law or by an authority within a shorter period. They only apply to you after you accept them, which the Game will ask you to do on screen. If you do not agree with a relevant change, you may keep playing in offline mode, with your Crystals available in the offline-mode shop, or close your account. Your online progress stays saved and comes back if you accept later. The rights the law grants you remain, including over what you have already bought.
- Corrections that do not change the meaning of the text (such as typos, links and contact details) apply when published, without new acceptance.
All versions of these Terms, with the effective date of each, are available on this page.
19. Governing law and jurisdiction
These Terms are governed by the laws of the Federative Republic of Brazil.
- If you are a consumer living in Brazil, you may bring a claim in the courts of your place of residence.
- If you live in another country, the courts of the District of Santa Rita do Sapucaí, Minas Gerais, Brazil, are chosen, without prejudice to the consumer protection rules of the country where you live that cannot be set aside by contract, including on jurisdiction.
Before taking any action, please contact us at contact@artxgames.com: most problems are solved quickly this way.
20. General provisions
- If any clause of these Terms is held invalid, the others remain in force.
- If we do not enforce a clause, this does not mean we waive the right to enforce it later.
- We may transfer these Terms to another company that takes over the Game, through a corporate reorganization or sale, with your rights preserved and notice to you.
- These Terms, the Privacy Policy and Steam's rules form the entire agreement between you and ART X about the Game.
- Language. These Terms are written in Portuguese and translated into English, Japanese, Russian, Spanish, Simplified Chinese, Traditional Chinese, Thai, Turkish, Korean, German, French, Italian and Polish. If the versions differ, the Portuguese version prevails, unless the law of your country requires otherwise.
